Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the milkypopup.com website and the Milky Popup Plugin (the "Service", "Software") operated by Milky Popup ("us", "we", or "our").

By accessing or using the Software, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Software License

The Milky Popup Plugin is licensed under the GNU General Public License v2.0 (or later). The core PHP code is licensed under the GPL, while custom CSS, JavaScript, and image assets are proprietary.

Upon purchasing a Pro or Agency tier, you are granted a license key that provides access to premium features, automatic updates, and support for a period of one (1) year.

• Pro Tier: Valid for one (1) single WordPress installation.
• Agency Tier: Valid for up to twenty-five (25) WordPress installations.

License keys may not be shared, resold, or distributed to third parties outside of the active client relationship defined in the Agency tier.

2. Subscriptions and Automatic Renewals

Milky Popup Plugin is sold as an automatically recurring subscription.

• By purchasing, you authorize us to automatically charge your payment method on file at the end of each billing cycle (monthly or annually) to ensure uninterrupted access to updates and support.
• You may cancel your subscription at any time through your account dashboard. If you cancel, you will retain access to premium features and support until the end of your current paid billing period.
• If your subscription expires or is canceled, the plugin will continue to function on your website, but you will permanently lose access to technical support, premium updates, and security patches.

3. 30-Day Money-Back Guarantee

We stand behind the quality of our product. We offer a 100% no-questions-asked refund within 30 days of your initial purchase.

• This guarantee applies strictly to new, initial purchases and does not apply to subscription renewals.
• To request a refund, you must contact our support team at hello@milkypopup.com within the 30-day window. Upon processing the refund, your premium license key will be deactivated immediately.

4. Software Updates and Support

Support and updates are available only to customers with an active, paid license key.

• Updates: We continuously release updates to ensure compatibility with the latest versions of WordPress, fix bugs, and introduce new features. We do not guarantee compatibility with older, unsupported versions of WordPress or third-party plugins.
• Support Scope: Support covers assistance with plugin installation, feature configuration, and bug reporting. It does not cover custom CSS/code development, debugging conflicts with heavily modified third-party themes or plugins, or general WordPress troubleshooting.
• Agency Support: Agency tier license holders receive priority email routing, meaning their tickets are escalated to the front of the support queue.

5. Data Ownership, Privacy, and GDPR

Milky Popup Plugin is a self-hosted WordPress plugin.

• Your Data: We do not track, collect, host, or sell the email addresses, leads, or analytics generated by your popups. All subscriber data and analytics are stored locally on your own WordPress server and database.
• Compliance: Because you own and host the data, you are solely responsible for ensuring that your data collection practices comply with local regulations (such as GDPR, CCPA, or CASL). Milky Popup provides the tools (such as terms and conditions checkboxes) to assist with compliance, but we assume no legal liability for how you collect or manage your website visitors' data.

6. Limitation of Liability

In no event shall Milky Popup, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Software.
• Any conduct or content of any third party on the Software.
• Any bugs, errors, or inaccuracies in the Software's code.

The Software is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties that the plugin will function flawlessly in all environments, especially given the vast number of WordPress configurations and third-party plugins in existence.

7. Modifications to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Software after those revisions become effective, you agree to be bound by the revised terms.
